Terms of Sales

PEARLA, a joint stock company with a capital of 1,000,000 XPF, whose registered office is located at BP 535 Vaitape 98730 Bora Bora French Polynesia, registered in the Trade and Companies Register of Papeete under the Tahitian number: 862 854 (“PEARLA”).

01 – Preamble

These general terms and conditions of sale (the “General Terms and Conditions“) are concluded between PEARLA and any non-trading individual (“You”) wishing to make a purchase on the Website.

These General Conditions exclusively govern your relationship with PEARLA.

PEARLA reserves the right to modify the General Conditions at any time. They will then be applicable as soon as they are put online.

02 – Products

The products governed by these General Conditions are those that appear on the Website and that are indicated as being sold and shipped by PEARLA (the Products). They are offered within the limits of available stocks.

The essential characteristics of the Products are described and presented as accurately as possible.

03 – Awards

The prices of the products are indicated in franc pacific all taxes included. They take into account the VAT and the possible reductions applicable to the day of the order. The parity of the Pacific Franc with the Euro is 1€ for 119,33 XPF.

The prices of the products are exclusive of customs entry tax and delivery charges (postage, packaging and preparation of the package according to the amounts in force). The amount of the delivery charges will be specified before validation of the order.

However, a price cannot be modified once your order has been validated. Nevertheless, in the event of a price error (price that is clearly derisory in relation to the real value of the Product), the validated order may be cancelled by PEARLA. This measure remains exceptional.

04 – Ordering

4.1 Prior identification

To place an order, you must identify yourself with your email address or your customer number, and your password. For any first order, you will have to create an account.

4.2 Registration and validation of the order

You have the possibility to place your order online from the online store. 

Once your shopping cart is validated, you must choose the address and delivery method, and validate your payment method, this last step formalizing the sales contract with PEARLA. 

Any order implies acceptance of the prices and descriptions of the products available for sale. 

PEARLA will acknowledge receipt of your order as soon as it is validated by sending you a confirmation email.

In certain cases, such as non-payment, incorrect address or any other problem related to your account, PEARLA reserves the right to block your order until the problem is resolved. 

In case of unavailability of an ordered Product, you will be informed by email. The cancellation of the order of this Product and its possible refunding (only the Products available at the time of the order can be the subject of a taking, by opposition to the deferred Products), will then be carried out, the remainder of the order remaining firm and definitive.

05 – Terms of payment

You can pay for your order: 

 – by credit card: Carte Bleue, Visa, Mastercard. Your account will be debited when you order. In case of out of stock or unavailable products, the amount of these Products will not be debited. 

 

06 – Delivery

The service times indicated below are not guaranteed during certain busy periods, such as sales periods and holiday periods. 

6.1. For available Products

By post (3 to 6 working days from the validation of your order – cost of 8.99 € or 1072 XPF ). Delivery is made by postoffice sending.

6.2. Delivery in the DOM TOM

By Post (9 to 12 working days from the validation of your order – cost of 21 € or 2505 XPF ). The delivery is made by postoffice sending

07 – Return of Products

Exercising the right of withdrawal 

In accordance with the provisions of Article L.121-21 of the Consumer Code, you have a withdrawal period of 14 days from receipt of your products to exercise your right of withdrawal without having to justify your reasons or pay a penalty.
The returns are to be made in their original condition and complete (packaging, accessories, snap device Tahitian cultured pearl). In this context, your responsibility is engaged. Any damage suffered by the product on this occasion may be of a nature to defeat the right of withdrawal. 
The return costs are (at your expense)
To exercise your right of withdrawal, You can send us a message with the title (return a Product to PEARLA), in particular by declaring your return online from your account, under the heading “CONTACT”. 
PEARLA will acknowledge receipt of your withdrawal by email.
You must then return the Products to PEARLA, at the latest within fourteen (14) days following your withdrawal:

– by Post at the following address SNC PEARLA SECRET AND LUXURY JEWEL, BP 535 VAITAPE 98730 BORA BORA French Polynesia. You are responsible for the cost of returning the product via La Poste (except in the case of a defective product upon receipt or an error by PEARLA when sending the product).

PEARLA undertakes to reimburse you the totality of the sums paid upon receipt of the Product in its warehouses or upon receipt of the proof of return of your package that You will have sent to the following address SNC PEARLA SECRET AND LUXURY JEWEL, BP 535 VAITAPE 98730 BORA BORA French Polynesia. As an indication, it generally takes between three (3) and four (4) weeks for a return to PEARLA’s warehouses. PEARLA will reimburse you for the returned Products, subject to compliance with the above-mentioned conditions, as well as for the standard “outbound” delivery costs of the latter if You return your entire order. The “one-way” delivery charges with supplements are reimbursed within the limit of the standard delivery charges. If you do not return your entire order and retain one or more of the Products ordered, the amount of the “outbound” delivery charges will not be refunded by PEARLA. The refund will be made via the payment method used for the returned order.

Thus, for example, if the Products order was paid for by :

– Credit Card, and your Credit Card is still valid, the refund will be made to the account attached to that Credit Card.

08 – Evidence

In all cases, the online provision of the credit card number and the final validation of the order will be considered as proof of the completeness of the said order in accordance with Article 1366 of the French Civil Code and will be considered as proof of the sums involved in the seizure of the Products appearing on the order form. This validation is worth signature and express acceptance of all the operations carried out on the Internet site. However, in the event of fraudulent use of your bank card, you are invited, as soon as this use is noticed, to contact the Customer Service of your bank.

The computerized registers, kept in the computer systems of PEARLA and its partners under reasonable security conditions, will be considered as proof of the communications, orders and payments made between you and PEARLA.

09 – Responsibilities

PEARLA has an obligation of result for all stages of the order taking process, as well as for the stages subsequent to the conclusion of the contract. Thus, PEARLA undertakes to describe the Products sold on the Website as accurately as possible. However, PEARLA may not be held liable in the event that the non-performance of its obligations is attributable either to the unforeseeable and insurmountable act of a third party to the contract or to a case of force majeure as defined by French case law. Likewise, PEARLA shall not be held liable for any inconvenience or damage inherent in the use of the Internet network, in particular a break in service, an external intrusion or the presence of computer viruses.

10 – Personal information

During your order, the personal data collected will be subject to computer processing. You are invited to refer to the tab ”Personal Data” of the Website to obtain all information relating to this point.

11 – Applicable Law and Jurisdiction

The General Conditions are subject to French law. The competent court in the event of a dispute shall be that of the defendant’s place of residence or, at the plaintiff’s option, the place where the Product was actually delivered. The Website complies with French law, and under no circumstances does PEARLA guarantee compliance with any local legislation that may be applicable to You when You access the Website from other countries.
